1) Assuming the LastMod of that file on Dest > 365 days, yes (because you've told it to delete such files)
2) No

You could use Versioning on Destination, set to keep max [1] copy for [as long as it might take you to notice the accidental deletion and retrieve the Versioned copy]. Note that this would capture [1] previous-version of any changed files for that long also. There's no facility to differentiate between changes & deletions (it's actually designed to capture previous-versions of changes - we just treat deletion as a fairly drastic change)
